INTRODUCTION
To help you get the most from your membership at J2GYM & Summit Fitness, and to ensure clarity regarding the rights and responsibilities of both members and the Gym, please read these Terms and Conditions carefully.
These Terms and Conditions form a legally binding agreement between:
You – the Member
and
J & J Leisure Ltd (Company No. 06285991) trading as J2GYM & Summit Fitness (“the Gym”, “we”, “us”, “our”).
By signing a membership agreement, completing an online sign-up, purchasing a membership or day pass, or using the Gym’s facilities, you agree to these Terms and Conditions.
To make this document easier to read it is divided into two parts:
Part A – Terms and Conditions of Membership
Part B – Rules and Regulations for Using the Facilities
These terms apply to all members, guests and visitors using the facilities.
PART A – TERMS AND CONDITIONS OF MEMBERSHIP
Definitions
Member – the individual who has entered into a membership agreement with the Gym.
Guest – a non-member permitted to access the facilities.
Facilities – all equipment, services, training areas, studios and amenities provided by the Gym.
The Gym – J2GYM & Summit Fitness operated by J & J Leisure Ltd.
1. RESPONSIBILITIES OF MEMBERS
1.1 Members must comply with these Terms and Conditions at all times.
1.2 Members must follow all rules and safety instructions displayed within the Gym.
1.3 Membership is personal and non-transferable.
1.4 Members must not allow any other person to use their membership access.
1.5 Members must behave respectfully toward staff and other members at all times.
2. ACCEPTANCE OF MEMBERSHIP
2.1 The Gym reserves the absolute right to accept or refuse any membership application.
2.2 Membership begins once the application has been accepted and the required payment has been received.
2.3 Upon joining, members may receive an access card, key fob, or digital entry credentials.
2.4 Replacement of lost or damaged access devices may incur a fee.
3. MEMBERSHIP AGREEMENT
3.1 The membership agreement becomes legally binding when the member accepts the terms during sign-up and the Gym confirms acceptance of the application.
3.2 Membership cannot be transferred to another individual.
3.3 Members are entitled only to the facilities included within their membership category.
4. MEMBERSHIP TYPES
The Gym may offer different membership categories including:
Monthly memberships
Annual memberships
Student or concession memberships
Promotional memberships
Short-term passes
The specific terms of each membership type will be communicated at the time of purchase.
The Gym reserves the right to amend, withdraw or introduce new membership categories.
5. LENGTH OF MEMBERSHIP
5.1 Certain memberships may include a minimum contract term.
5.2 Where applicable, memberships may automatically renew unless cancelled in accordance with the notice requirements.
5.3 The minimum commitment period and notice requirements will be clearly stated during sign-up.
6. STARTING YOUR MEMBERSHIP
When joining the Gym:
You may be required to pay a joining fee or administration fee.
You may be required to pay a pro-rata payment covering the period until the next billing cycle.
The Gym may take a photograph of you for identification and security purposes.
7. MEMBERSHIP FEES
7.1 Membership fees must be paid in advance.
7.2 Where payments are made by Direct Debit, payments will be collected monthly.
7.3 If a Direct Debit fails the Gym may attempt to collect payment again and access to the Gym may be suspended until payment is received.
7.4 The Gym reserves the right to charge administration fees for repeated failed payments.
8. ACCESS AND MEMBERSHIP CARDS
8.1 Members must use their membership card, fob or digital access credentials when entering the Gym.
8.2 Membership access must not be shared.
8.3 If another person uses your membership access, your membership may be terminated immediately.
9. NOTICE PERIODS
9.1 Cancellation of membership requires written notice.
9.2 The required notice period will depend on the membership type.
9.3 Notice must be submitted in writing via email, the membership portal, or written notice delivered to the Gym.
10. ADDITIONAL CHARGES
Certain services may incur additional fees including:
Personal training sessions
Specialist classes
Replacement membership cards
Retail products
The Gym will display current charges at reception or on its website.
11. ENDING YOUR MEMBERSHIP
Membership may be ended by the member giving appropriate notice, or by the Gym where these Terms and Conditions are breached.
Members must continue paying membership fees until the end of the notice period.
12. EARLY TERMINATION
Membership may be cancelled early in exceptional circumstances including:
Serious medical conditions preventing exercise
Relocation to a location significantly distant from the Gym
Other significant personal circumstances at the Gym’s discretion
Evidence may be required.
13. CANCELLATION BY THE GYM
The Gym may suspend or cancel membership if a member:
Breaches these Terms and Conditions
Behaves aggressively or abusively
Damages equipment or facilities
Allows another person to use their membership
The Gym may refuse future membership applications in these circumstances.
14. NON-PAYMENT OF FEES
If membership fees remain unpaid, access may be suspended and outstanding payments may be referred to a debt collection agency.
Cancelling a Direct Debit does not automatically cancel membership.
15. CHANGES TO MEMBERSHIP FEES
The Gym may increase membership fees from time to time.
Members will be given reasonable notice of any changes.
16. COMPLAINTS
If you have a complaint:
Speak to a member of staff.
If unresolved, contact the Gym Manager.
If still unresolved, contact the Gym’s management team in writing.
The Gym will aim to resolve complaints promptly.
17. LIABILITY AND RISK WAIVER
IMPORTANT – PLEASE READ CAREFULLY
17.1 Physical exercise carries inherent risks including muscle injuries, joint injuries, falls, cardiovascular incidents, illness or death.
17.2 By using the Gym facilities you acknowledge and accept these risks.
17.3 Members confirm they are physically capable of undertaking exercise and will seek medical advice if necessary.
17.4 Members participate in all activities entirely at their own risk.
17.5 To the fullest extent permitted by law, J & J Leisure Ltd trading as J2GYM & Summit Fitness, including its directors, employees, trainers and contractors, shall not be liable for any injury, illness, loss or damage suffered while using the facilities, except where caused by the Gym’s proven negligence.
17.6 Members agree to indemnify the Gym against claims arising from misuse of equipment or failure to follow Gym rules.
17.7 Personal belongings are brought onto the premises at the owner’s risk.
18. DATA PROTECTION
The Gym processes personal data in accordance with UK data protection legislation including the UK GDPR and Data Protection Act 2018.
Personal data will be handled according to the Gym’s Privacy Policy.
19. GUESTS AND PASSES
Members may introduce guests subject to Gym policy.
Members must ensure guests follow all Gym rules and complete any required health declarations.
Members remain responsible for their guests’ behaviour.
20. PROMOTIONS
The Gym reserves the right to withdraw promotions at any time and amend promotional offers without notice.
Promotions cannot be exchanged for cash.
PART B – RULES FOR USING THE FACILITIES
1. HEALTH AND SAFETY
Members must exercise responsibly and follow all health and safety instructions.
Members should not undertake exercise beyond their capabilities.
If you feel unwell while exercising you must stop immediately and inform a member of staff.
2. MEDICAL CONDITIONS
Members must consult a medical professional before exercising if they have heart conditions, high blood pressure, injuries or medical conditions affecting exercise.
Members must inform staff of any relevant medical conditions.
3. EQUIPMENT USE
Members must use equipment correctly, return weights after use, and avoid dropping weights.
Misuse of equipment may result in membership termination.
4. MEMBER CONDUCT
Members must behave respectfully at all times.
The Gym operates a zero-tolerance policy for abusive behaviour, harassment, threats or violence.
Members behaving inappropriately may be removed from the premises.
5. LOCKERS
Lockers are provided for temporary use only.
The Gym accepts no liability for loss or theft of items stored in lockers.
Items left overnight may be removed.
6. CAR PARK
Parking is provided where available.
Vehicles are parked entirely at the owner’s risk.
The Gym accepts no responsibility for damage or theft.
7. PHOTOGRAPHY AND FILMING
Photography is permitted for personal use only.
Members must not film other members without their consent.
Filming is strictly prohibited in changing areas.
8. GENERAL RULES
Members must follow all safety signage, wear appropriate gym attire, and respect other members.
Smoking and illegal substances are prohibited.
GOVERNING LAW
These Terms and Conditions are governed by the laws of England and Wales.
